This Website is intended for users over 18 years of age, and its use by anyone under that age is prohibited. In addition, the user responsibly acknowledges that they have sufficient legal capacity to subscribe, where applicable, to the services offered on the Website.

The Controller of the personal data collected through the Website is Hortifrut Limited, an entity incorporated under the laws of the Republic of Ireland, with Company Registration Number 701701 and registered office at Ella House, Suite 40.1, 40 Merrion Square East, Dublin 2, D02 NP96, Ireland (hereinafter, Hortifrut). Berry Good is a trade mark owned by Hortifrut Limited and does not constitute a separate entity for data protection purposes.

2. What type of personal information do we collect?

Hortifrut may collect the following personal information from users, through the forms made available on the Website or through the other communication channels made available by Hortifrut, although we will always request data that is adequate, relevant and limited to what is necessary in relation to the processing purposes referred to above, in accordance with the principle of personal data minimisation:

In accordance with the data protection legislation in force, in all matters concerning the proper processing of personal information by Hortifrut, this entity may also retain the information for the time necessary for the corresponding purpose and, once that purpose has been fulfilled, only for the time necessary to address any liabilities arising from the processing, with erasure upon expiry of the applicable limitation periods.

As a general rule, where personal data is no longer necessary for the processing purposes for which it was collected, it will be blocked and made available solely to the competent authorities for the possible determination of any legal liabilities arising during its processing, always in accordance with the applicable legislation, and it may not be used for any purposes other than these. 5. What rights does the user have and how can they be exercised?

The user has the right:

to access their personal data, including confirmation as to whether or not their personal data is being processed, and the basic information relating to such processing, as well as to obtain a copy of the personal data undergoing processing;

to request the rectification of inaccurate data;
to request erasure where, among other reasons, the data is no longer necessary for the purposes for which it was collected;

Hortifrut, including its Berry Good brand, may maintain profiles on the main social media networks (Facebook, Instagram and LinkedIn, among others).

Where users have a profile on any of these social media networks and contact Hortifrut by this or by any other means, the personal data provided by the user, and the data that is visible as a user of the relevant social network, will be processed by Hortifrut, within the social network itself, in order to respond to such requests through the relevant social network’s own channels, applying this privacy policy for these purposes.

In particular, any personal data provided to us by the user through the aforementioned social media networks will be processed solely in order to handle their query or request. The information collected will generally be limited to identification and contact data, as well as data relating to the nature of the request addressed to us.

The user has the right to exercise their rights, as explained in this privacy policy. However, the exercise of these rights will be determined by the functionalities of the relevant social network, and these rights may be exercised only in relation to the information that is under Hortifrut’s control.

Under no circumstances will Hortifrut extract data from social media networks, unless the user’s specific and express consent has been obtained for that purpose.
